Pedestrian Accidents in Connecticut

Under the law, a pedestrian is defined as anyone traveling along a sidewalk or roadway without a motorized vehicle. This includes people on foot, such as joggers, students walking to school, or anyone out for a stroll. Pedestrians also include individuals in wheelchairs, small children on toys like scooters or tricycles, and anyone else using the road without a motorized vehicle. Essentially, if you’re in the roadway without a motorized vehicle, you are considered a pedestrian.

The Dangers of Pedestrian Accidents

Pedestrian accidents are among the most dangerous types of traffic incidents. These accidents often result in severe injuries—or even fatalities—because pedestrians are completely unprotected against the force of a motor vehicle, even when the vehicle is moving slowly. Virtually all pedestrian accidents result in injuries, and these incidents can be particularly tragic when they involve children.

The law in Connecticut treats pedestrian accidents in much the same way it handles car-on-car collisions. Victims of pedestrian accidents are entitled to recover the full cost of their medical bills, lost wages, and other damages caused by the accident. However, determining fault is essential in these cases, as the person or party at fault (or their insurance company) will be held responsible for covering the damages.

Who Is at Fault in a Pedestrian Accident?

Determining fault in a pedestrian accident depends on the specifics of the incident. While pedestrians are generally given the right of way, they are not automatically free from responsibility. For example, if a pedestrian crosses the road illegally or suddenly runs out without warning, they may bear some or all of the fault for the accident—even if they are the ones who suffered the most severe injuries.

Distractions caused by cell phone use—whether by the driver, the pedestrian, or both—are also a common factor in pedestrian accidents. Additionally, the presence or absence of sidewalks and crosswalks can play a role in determining fault. Many roads in Connecticut lack sidewalks, but pedestrians are still legally allowed to walk along the side of the road or even in the roadway under certain circumstances. The details of the accident, including whether crosswalks were marked and how vigilant each party was, will help establish who is responsible.

What Happens If the Pedestrian Is at Fault?

If a pedestrian is found to be at fault for an accident, they could be held liable for the driver’s costs, such as vehicle damage or other related expenses. However, this is rare. In most cases, drivers are found to have at least partial responsibility because they are required by law to remain vigilant and yield to pedestrians.

Bicycle accidents are often treated similarly to pedestrian accidents. However, unlike pedestrians, bicyclists are expected to follow many of the same traffic laws as motor vehicles.
