What is a Legal Injury?

When we hear the word “injury,” we often think of physical harm—a broken arm, a concussion, or some other condition that might require medical attention. However, the legal definition of injury extends far beyond physical wounds. In legal terms, an “injury” refers to any harm done to a person, whether it’s physical, emotional, financial, or reputational. The law recognizes individuals as more than just physical beings; we are people with rights, dignity, and a sense of personhood. Any violation of these is considered a serious injury under the law.

Legal injuries may include:

  • Damage to a person’s reputation (defamation or slander)
  • Destruction, damage, or theft of property
  • Violations of legal rights
  • Physical harm or health issues
  • Wrongful death
  • A combination of any of the above

In most cases, the person or entity responsible for the injury can be held legally liable for the harm caused.

Who is Liable for an Injury?

Liability often depends on how the injury was caused. For example, someone may be liable if they:

  • Acted negligently, such as driving while distracted
  • Caused intentional harm, such as in cases of assault or theft
  • Violated a legal duty, such as breaching a contract

In these situations, the responsible party, often referred to as the “tortfeasor,” may be required to pay financial compensation (known as “damages”) to the injured person. This compensation is meant to cover the costs of the injury and help the victim recover from the harm done.

There are exceptions to liability. For instance, if you acted in self-defense and injured someone while protecting yourself, you are generally not considered liable for their injuries. Courts recognize that such actions are justified and unlikely to result in a successful lawsuit against you.

Examples of Legal Injuries

At Bert McDowell Injury Law, we frequently encounter cases where individuals suffer from various types of legal injuries. For example:

  • Medical device claims: Imagine you had a medical device implanted but were not warned of a serious side effect. If you later suffered from that side effect, the manufacturer could be held liable for failing to warn you. You have the right to make informed decisions about your health, and withholding critical information is a violation of that right.
  • Car accidents: If a distracted driver causes an accident that results in your injury, they can be held accountable for their negligence.
  • Workplace injuries: Employers may be liable for unsafe working conditions that lead to accidents or health issues.

Regardless of the situation, the law is designed to protect you and hold the responsible party accountable for their actions.

How Do Damages Help Injury Victims?

While financial compensation cannot erase the pain or trauma caused by an injury, it can help victims recover and rebuild their lives. Damages are meant to make the injured person “whole” again, as much as possible. This might involve replacing lost property, covering medical bills, or providing financial support to offset long-term impacts of the injury.

Common types of damages include:

  • Medical expenses, including long-term care and rehabilitation
  • Repair or replacement of damaged property
  • Lost wages and compensation for reduced earning capacity
  • Compensation for pain, suffering, and emotional distress
  • Support for permanent disabilities or lifestyle changes

In many cases, damages provide a financial lifeline for victims and their families during difficult times. This is why the legal system takes injury claims and compensation seriously.
